Notice of Financial Incentive
This page exists because the California Consumer Privacy Act, codified at California Civil Code §1798.125(b), and Title 11 California Code of Regulations §7080, require a business to publish a notice of financial incentive whenever it offers a price difference, service difference, or other financial benefit in exchange for the collection, retention, sale, sharing, deletion, or limit-use waiver of personal information.
Current status
As of 9 May 2026, Opuliss does not offer a financial incentive that would trigger §1798.125. Specifically:
- Newsletter signup ("Be First" on opuliss.com) is voluntary. There is no discount, free product, free shipping offer, or other monetary benefit conditioned on providing your email address. The benefit you receive is editorial communication and early access to product launches, which is not a financial incentive under §7080(c) of the regulations.
- We do not run a loyalty program, points program, tiered membership, or any program that offers a price difference based on whether you allow us to collect, sell, share, or retain your personal information.
- We do not offer a discount or other monetary benefit in exchange for waiving your right to delete personal information, opt out of sale or sharing, or limit the use of sensitive personal information.
Because no financial incentive program is currently in place, the notice content required by §7080(d) (succinct summary of incentive, material terms, opt-in method, opt-out method, good-faith estimate of the value of personal information, and the method used to calculate that value) is not applicable today.
What changes if we introduce a financial incentive
If Opuliss launches a loyalty program, a discount-for-email offer, a referral credit program, a paid membership, or any other program that conditions a price or service difference on the collection or use of your personal information, we will:
- Update this page with a succinct description of the program.
- Disclose the material terms, including categories of personal information collected, retention period, and how the program is connected to the value of that information.
- Describe the opt-in mechanism, which under §1798.125(b)(3) must be affirmative, and the opt-out (right-to-revoke) mechanism, which must be at least as easy as the opt-in.
- Provide a good-faith estimate of the value of the consumer's personal information, calculated using one of the methods listed in §7080(d)(2)(A), and disclose that calculation method.
- Confirm that the value of the financial incentive is reasonably related to that good-faith estimate, as required by §1798.125(b)(4).
We will also update the California-resident opt-in language in our newsletter signup form to reference the active notice, and we will email any subscriber who joined under the prior version to invite them to opt in or opt out under the new terms.
Why we are publishing this notice anyway
The "Be First" newsletter form on opuliss.com asks California residents to acknowledge this notice. We publish this page so that the link resolves to a transparent statement of where we are today, rather than a 404 or a generic placeholder. We would rather state plainly that no incentive is in place than imply one is by leaving the link broken.
