These Terms of Use (“Terms”) constitute a legal agreement between Opuliss Beauty LLC, on behalf of itself and its subsidiaries and affiliates (“Opuliss Beauty,” “us,” “our,” or “we”), and you, and, if applicable, the entity or person on whose behalf you are entering into these Terms (also referred to as “your”).
Please read these Terms carefully. By clicking the acceptance box and/or using our websites, opuliss.com or opulissbeauty.com (collectively, “Website”), you agree to be bound by these Terms. If you do not agree with these Terms, please do not click the box, access the Website, or place an order.
We recommend that you print or save a copy of these Terms for your records, as we may update them from time to time.
We dispatch from two origins and the destinations differ between our two ranges. Opuliss Beauty reaches the United States and Canada, and 22 further countries named in our Shipping Policy. European Union addresses are not currently served by that range. Opuliss Skin reaches three countries: the United States, the United Kingdom and France. Canadian addresses are not currently served by that range. The destinations available to you are shown at checkout.

Important Note: Please read carefully the sections titled “Right to Cancel; Returns; Refunds,” “Price and Payment,” “Arbitration,” “Exclusions and Limitations of Liability,” “Indemnification,” “Disclaimers,” and “Product and Shipping
Compliance.” These provisions limit liability, affect dispute resolution, including by arbitration without any right to a jury trial, and outline compliance with
cross-border shipping and cosmetics regulations. California residents, for more

1. Our Details

Opuliss Beauty LLC operates the Website (opuliss.com and opulissbeauty.com) and sells goods and services. Opuliss Beauty LLC is a Minnesota limited liability company. Opuliss Beauty, our cosmetics range, is made in the United States and ships from North America. Opuliss Skin, our skincare range, is made in the European Union and ships from Europe. 2. Your Responsibility for Others

You must ensure that any persons who access our Website on your device(s) are
aware of these Terms and all referenced documentation, and that they agree to
comply with them. If they do not agree, they must not access or use our Website,
and you must not permit them to do so.

We provide this Website subject to these Terms as well as:

4. Changes to These Terms

We reserve the right to update these Terms at our sole discretion. Changes are
effective immediately upon posting and apply to all subsequent access, use, and
purchases. You must check these Terms each time you access our Website to ensure you are aware of the applicable terms. The effective date at the top indicates
the latest revision.

5. Your Account Details

Certain functionalities may require you to register for a user account (“Account”). You agree to provide accurate, complete, and current information during registration, including a valid shipping address in a destination we serve, and to update it as necessary. You must keep your login information confidential and not authorize third-party use. You are responsible for all account activity and must notify us immediately at info@opuliss.com of any unauthorized use or security breach. We may cancel or suspend your registration at our discretion.

6. Ownership of Material

All intellectual property rights in our Website and its contents are owned by or
licensed to us and protected by United States, Canadian, Mexican, and international copyright, trademark, patent, trade secret, and other intellectual property
laws. Any unauthorized use is strictly prohibited. Third-party trademarks displayed on the Website are owned by their respective owners, and no license is
granted without their prior written permission.

7. Reliance on Information

The Website provides general information about us and our products. We do
not warrant its accuracy, completeness, or usefulness. Third-party content is
the responsibility of its providers, and we are not liable for its accuracy or any
reliance you place on it.
8. Content on Our Website
Content is for personal, non-commercial use only. You may print or share content for lawful personal purposes but may not reproduce, modify, or distribute

it without our prior written consent, except for temporary storage or caching as
specified. Unauthorized use may violate copyright and other laws.

9. Prohibited Uses

You must use the Website for lawful purposes only and not:

10. Geographic Restrictions

The Website is available internationally, and the destinations we can ship to depend on the range. Opuliss Beauty reaches the United States and Canada, and 22 further countries named in our Shipping Policy. European Union addresses are not currently served by that range. Opuliss Skin reaches three countries: the United States, the United Kingdom and France. Canadian addresses are not currently served by that range. If your country does not appear at checkout, we cannot currently serve it. Access from other regions is at your own risk, and you are responsible for compliance with local laws. Opuliss Beauty, our cosmetics range, is made in the United States and ships from North America. Opuliss Skin, our skincare range, is made in the European Union and ships from Europe. Each shipment is subject to the export requirements of its origin and the import requirements of the destination country.

11. Links to Other Websites

Third-party links are provided for convenience. We are not responsible for linked
sites’ content or terms. You may need additional products or services to use
linked sites, which you must obtain separately.

12. Calls and/or Text Messages

By providing your phone number, you consent to receive calls or texts from
us, including automated messages, for marketing or service purposes, in compliance with Canadian Anti-Spam Legislation (CASL), U.S. Telephone Consumer
Protection Act (TCPA), and Mexican data protection laws. You may opt-out at any
time. Message and data rates may apply.

13. Product Purchases

Add the products you want to your bag and press the payment button at checkout. Your delivery destination and the shipping charge are confirmed at checkout before you pay. You will receive an order confirmation email, which does not constitute acceptance. Acceptance occurs upon dispatch. We may reject orders due to stock issues, payment authorization failures, suspected fraud, or non-compliance with export or import regulations, and will refund any payments within 7 business days. Opuliss Beauty, our cosmetics range, is made in the United States and ships from North America. Opuliss Skin, our skincare range, is made in the European Union and ships from Europe.

14. Changing Your Order

Once an order is placed, changes to details like delivery address or products cannot be made due to our fulfillment process. This does not affect your legal right

15. Our Products

Orders are subject to availability. We strive to ensure accurate product descriptions and prices but reserve the right to correct errors and cancel orders arising from inaccuracies. Product images are illustrative, and actual products may vary slightly. Our cosmetics are produced to United States Food and Drug Administration (FDA) cosmetic labeling and safety requirements. Our skincare is produced in the European Union under Regulation (EC) No 1223/2009 on cosmetic products. Product labeling follows the requirements of the market a product is made for.

16. Delivery

Delivery destinations and estimated lead times are displayed at checkout. Opuliss Beauty reaches the United States and Canada, and 22 further countries named in our Shipping Policy. European Union addresses are not currently served by that range. Opuliss Skin reaches three countries: the United States, the United Kingdom and France. Canadian addresses are not currently served by that range. An order containing both ranges is dispatched as two shipments from their two origins, and checkout will show a shipping charge for each; the parcels travel independently and may arrive on different days. Shipping dates are estimates, and we are not liable for delays, including those caused by customs clearance. You are responsible for providing accurate delivery information that complies with the import requirements of your destination. If we cannot ship within 30 days, we may request your consent to delay or cancel the order with a refund, including shipping fees, within 7 business days.

17. Right to Cancel; Returns; Refunds

You may return products purchased from opuliss.com within 30 days of the date your order is delivered, in new or gently used condition, for a refund of the purchase price to your original payment method. Original shipping charges are not refunded. Refunds requested after 30 days are not guaranteed and are made at our discretion. Items marked final sale at the time of purchase, products that are substantially used or damaged after delivery, and products purchased from any source other than opuliss.com or an authorised stockist are not eligible for return.

Separately, and without the 30 day limit above, you may request a refund for products that arrive damaged, or that do not comply with the cosmetic regulations applicable to them, by contacting info@opuliss.com with photos, order details, and proof of damage. Refunds for damaged goods include shipping costs where applicable. Cross-border returns may incur additional customs fees, for which you are responsible. 18. Our Online Store

Our store is hosted on Shopify Inc., which processes orders and payments in
compliance with Canadian, U.S., and Mexican data protection laws. Your data is

stored securely per our Privacy Policy and Shopify’s privacy statement (https:
//www.shopify.com/legal/privacy).

19. Price and Payment

Product prices are shown in U.S. dollars, exclusive of shipping, duties, and taxes, which are added at checkout where they apply. We accept various payment methods, processed securely via Shopify. Import duties, taxes and customs charges are set by the destination country and are the responsibility of the recipient. You authorize us to verify your payment information.

20. Product Restrictions

We are not liable for inability to deliver products due to legal or regulatory restrictions in the origin or destination country. Certain ingredients, for example flammable substances or restricted chemicals, may be classified as dangerous goods under the transport regulations that apply to a shipment, requiring special handling. We will notify you promptly if such restrictions prevent delivery post-order.

21. Discount Codes

Only one discount code per order is allowed. We may reject orders using multiple codes. Discount terms govern eligibility and use.

22. Promotions

Promotions are subject to our rules and applicable Canadian, U.S., and Mexican
laws. Prizes are non-transferable and provided “as is.” We may modify or terminate promotions at our discretion.

23. Delay and Events Beyond Our Control

We are not liable for delays due to events beyond our control, including customs
delays, trade disputes, or weather affecting Canadian shipping routes. We will
notify you of significant delays, and you may cancel with a refund if delays are
substantial.

24. Product and Shipping Compliance

Opuliss Beauty, our cosmetics range, is made in the United States and ships from North America. Opuliss Skin, our skincare range, is made in the European Union and ships from Europe. Our cosmetics comply with FDA labeling and safety requirements. Our skincare is manufactured in the European Union under Regulation (EC) No 1223/2009. Product labeling follows the requirements of the market a product is made for. You are responsible for ensuring your delivery address complies with the import regulations of your country and for any duties, taxes, or clearance fees. We are not liable for delays or rejections due to non-compliant documentation or restricted ingredients, for example flammable goods or prohibited substances.

25. Arbitration

Disputes are subject to binding arbitration under the Federal Arbitration Act,
administered by AAA, JAMS, or another agreed provider. Each party bears its
own costs, and class action claims are waived.
26. Exclusions and Limitations of Liability
To the maximum extent permitted by law, we are not liable for any direct, indirect, or consequential losses arising from your use of the Website or products,
including losses due to customs delays, regulatory rejections, or data loss.

27. Indemnification

You agree to indemnify us against claims arising from your use of the Website,
breach of Terms, or violation of third-party rights, including intellectual property related to product manufacturing or distribution.

28. Disclaimers

Products and the Website are provided “as is” without warranties of merchantability, fitness, or non-infringement. We do not guarantee error-free or secure operation, or compliance with local regulations beyond the cosmetic standards applicable to each range as described in these Terms.

29. Age Restrictions

Users must be at least the age of majority in their jurisdiction or have parental
consent if between 13 and 17. We do not collect information from children under
13.

30. Suspension and Termination

We may suspend or terminate access to the Website or your account at any time,
including for non-compliance with export/import regulations. Certain provisions survive termination.

31. Notices

Notices will be posted on the Website or sent to your provided email. Send notices to info@opuliss.com.

32. Governing Law

These Terms are governed by California law, except for the arbitration provision, which is governed by the Federal Arbitration Act. Manufacturing and shipping are additionally subject to the laws of the country each range is made in and dispatched from.

33. Notice to California Residents

If the Website is deemed an electronic commercial service, California residents
may contact us at info@opuliss.com to file complaints or seek information.

34. General

If any provision is unenforceable, it will be modified or severed to the extent necessary. These Terms constitute the entire agreement between you and Opuliss
Beauty.
